CBD vaping in Switzerland: safety, e-liquids & rules to know

CBD vaping, CBD e-liquid, e-cigarettes, disposable vapes and flower vaporisers are not exactly the same thing. In Switzerland, product category, composition, labelling and equipment determine the relevant rules and precautions.

KEY POINTS

The essentials in 30 seconds

01

E-cigarettes: with or without nicotine

Since 1 October 2024, the Swiss Tobacco Products Act has regulated e-cigarettes with and without nicotine and their refill liquids.

02

Sale prohibited to under-18s

The ban applies throughout Switzerland, including online sales; a simple “I am 18” checkbox is not a sufficient check.

03

Vaping is not allowed everywhere

E-cigarettes are prohibited where passive-smoking legislation prohibits smoking.

04

CBD and THC remain separate data

CBD percentage or content cannot establish THC percentage or content; check the actual product composition.

01 CBD vape, e-liquid, disposable vape or vaporiser: what are they? Identify the format before discussing safety or legality. TAP TO OPEN

CBD vape often refers to several different products. A CBD e-liquid is intended for a compatible e-cigarette. A puff is a disposable or prefilled e-cigarette. A dry-flower vaporiser heats plant material and does not work like an e-cigarette filled with e-liquid.

These formats are not interchangeable. The liquid, coil, tank and material used must match the manufacturer's instructions.

02 What has Swiss law said since 1 October 2024? Understand the “e-cigarette” category without conflating it with CBD. TAP TO OPEN

The LPTab and its ordinance entered into force on 1 October 2024. They regulate, among other things, e-cigarettes with and without nicotine, refill liquids, certain heated plant-based products and herbal smoking products.

Containing CBD therefore does not place a product outside all regulation. For hemp, the 1% THC threshold remains central under narcotics legislation, while other requirements depend on product category.

03 Minimum age, online sales & advertising Swiss rules protecting minors are now uniform. TAP TO OPEN

Supplying e-cigarettes to under-18s is prohibited throughout Switzerland, including online. The FOPH states that clicking to confirm age is insufficient: sellers must implement checks that genuinely enforce the supply ban.

Advertising, promotion and sponsorship are also regulated, particularly to protect minors. Cantons may impose certain stricter rules.

04 Composition, labelling & CBD/THC levels Read product information before looking at design or flavour. TAP TO OPEN

Before comparing two products, check composition, presence or absence of nicotine, volume, intended use, warnings, manufacturer or importer and applicable regulatory information.

For cannabinoids, clearly distinguish CBD percentage, CBD content, THC percentage and THC content. A flavour or strain name never replaces composition data.

05 Aerosols, equipment & compatibility: what to avoid Reduce equipment mistakes and improvised mixtures. TAP TO OPEN

Vaping avoids the direct combustion of a traditional cigarette, but this does not make the aerosol risk-free. Liquid composition, device, operating temperature and coil condition affect what is inhaled.

Do not add oil, extract or material not explicitly intended for the device. Do not use e-liquid in a dry-flower vaporiser or resin in a device not designed for it.

06 Where can you vape and what precautions remain? Follow public-place rules and remain mindful of composition. TAP TO OPEN

Since the new regulation entered into force, e-cigarettes are prohibited wherever smoking is prohibited under federal passive-smoking legislation.

Keep products and devices out of children's reach. Do not drive if your ability may be impaired and consider the full product composition, particularly THC content.

CHOOSING A PRODUCT

Which product would you like to understand?

Start by identifying the format: e-liquid, e-cigarette or flower vaporiser.
01
Check composition first

CBD, THC, any nicotine, volume, warnings and compatibility must be clearly identified.

SAFETY & RULES

Three points never to confuse

01
CBD ≠ legal category

The word CBD does not cancel rules applying to e-cigarettes or heated products.

02
Nicotine-free ≠ unregulated

The LPTab also covers nicotine-free e-cigarettes.

03
Vaping ≠ risk-free

No direct combustion does not make aerosol exposure neutral.

FAQ

Frequently asked questions

Are nicotine-free CBD e-liquids covered by the Tobacco Products Act?

Yes. The FOPH states that the law covers e-cigarettes with and without nicotine and their refill liquids.

Can a CBD vape be sold to someone under 18 in Switzerland?

Not for e-cigarettes covered by the LPTab: supply to minors has been prohibited throughout Switzerland since 1 October 2024, including online.

Can you vape where smoking is prohibited?

Generally not: e-cigarettes are now subject to prohibitions where passive-smoking legislation bans smoking.

Can CBD e-liquid be used in any device?

No. Follow the compatibility specified by the device and liquid manufacturers.

Does less than 1% THC mean all rules disappear?

No. The THC threshold concerns narcotics legislation in particular; market requirements also depend on product category, composition and intended use.
